These Terms of Service ("Terms") apply to the FanFit AI application (the "App") for mobile devices, created by an independent developer based in Germany ("we," "us," "our," or the "Service Provider") and offered as a freemium service.

1. Use of the Service

By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

FanFit AI is an AI-powered photo styling app for football fans. You upload a photo of yourself, choose a football fan or cheer-squad style, and the App uses AI to generate a new game-day look that you can preview and save.

Unauthorized copying, modification, reverse engineering, or distribution of the App, any part of it, or our trademarks is strictly prohibited.

2. Independence and No Affiliation

FanFit AI is an independent fan-created app. It is not affiliated with, endorsed by, sponsored by, or associated with any football association, federation, team, club, league, event organizer, sportswear manufacturer, or player.

All outfit styles are original designs inspired by general fan and cheer aesthetics. The App does not reproduce official uniforms, team crests, brand logos, or the names or likenesses of real players. Any resemblance to real-world colors or styles reflects general fan culture only and does not imply any official relationship.

3. Eligibility and Age Requirements

You must be at least 13 years old to use the App. If you are located in the European Economic Area (EEA) or the United Kingdom, you must be at least 16 years old, or have the consent of a parent or legal guardian where required by local law. By using the App, you confirm that you meet these age requirements.

4. Accounts and Guest Mode

The App can be used in guest mode or by signing in. Sign-in is provided through Sign in with Apple or Google Sign-In. When you choose Google Sign-In, your use of Google's authentication services is also subject to Google's own terms. You are responsible for maintaining the security of your account and for all activity that occurs under it.

5. User Content and Data

5.1 Content You Provide

The App processes the photos you choose to upload in order to generate your AI outfit result ("Generated Results").

5.2 Ownership

You retain ownership of the photos you upload. You also own the Generated Results, subject to the license below and to applicable law.

5.3 Photo Processing and Retention

• Uploaded photos are processed on our own AI service to generate your outfit result. We do not send your photos to any third-party AI provider.
• Original uploaded photos are deleted after the result is generated.
• Generated Results are retained until you choose to delete them. You can delete a Generated Result at any time within the App.
• Your photos are used solely to provide the AI generation feature you requested.
• We do not use your photos to train AI models, and we do not sell your photos or Generated Results.

5.4 License to Operate the Service

To provide the App's features, you grant us a limited, non-exclusive license to process and temporarily handle your uploaded photos on our AI service solely for the purpose of generating your requested result, and to store your Generated Results until you delete them. This license exists only to operate the service and ends with respect to your uploaded photos once they are deleted after generation.

6. AI-Generated Content

FanFit AI produces AI-generated images. You understand and agree that:

• AI results may vary in quality and may not always match your expectations. This is inherent to AI generation.
• Ownership and copyright status of AI-generated content varies by jurisdiction and remains an evolving area of law. We make no representation or warranty about whether any Generated Result is protectable by copyright or who holds any such rights.
• We grant you a license to use the Generated Results you create with the App for your personal and lawful purposes.
• You are responsible for how you use, share, or distribute your Generated Results.

7. User Responsibilities and Prohibited Use

You agree to use the App only for lawful purposes. Specifically, you agree not to:

• Upload photos of anyone other than yourself unless you have that person's explicit permission.
• Upload photos of public figures, celebrities, athletes, or other individuals without authorization.
• Create non-consensual images or manipulate images of others without their explicit consent.
• Upload or generate content that is sexually explicit, nude, offensive, hateful, harassing, or otherwise inappropriate.
• Use the App to attempt to remove clothing from photos or to create sexually explicit imagery of any person.
• Upload content that infringes any third party's intellectual property, privacy, or publicity rights.
• Attempt to bypass any safety filters or content moderation.
• Use the App in any way that violates applicable local, national, or international law.

We maintain a zero-tolerance policy for misuse. We reserve the right to suspend or terminate access for anyone who violates these Terms.

8. Virtual Currency and Purchases

The App offers optional in-app purchases of consumable coins.

• Coins are a consumable virtual currency used to generate AI outfit results within the App.
• Coins have no monetary value, cannot be exchanged for cash, and are not transferable.
• Once used, coins are consumed and are non-refundable, except where a refund is required by applicable law.
• All purchases are processed by Apple through the App Store and are subject to Apple's terms and refund policies. Please direct payment and refund requests to Apple where applicable.
• We may change coin pricing, packages, or the amount of coins required for a feature at any time.

9. Third-Party Services

The App does not display advertising and does not include any third-party advertising SDKs. AI generation is performed on our own service and is not outsourced to any third-party AI provider.

The App relies on the following third-party services:

• Apple: Sign in with Apple for authentication and the App Store for in-app purchases. Your use of Apple's services is subject to Apple's own terms.
• Google: Google Sign-In for optional authentication. Your use of Google Sign-In is subject to Google's own terms.
• Adjust (Adjust GmbH): The Adjust SDK is used solely for marketing attribution and fraud prevention — for example, to attribute installs and in-app events to their source and to detect install fraud. It is not used to serve advertising. The Adjust SDK may collect device and event data as described in our Privacy Policy; your use of the App in connection with Adjust is subject to Adjust's own terms and privacy policy.

Details about the data collected by these services, including how to opt out of Adjust tracking via the iOS App Tracking Transparency prompt, are set out in our Privacy Policy.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied. Without limitation:

• AI-generated results may vary in quality and accuracy depending on the input photo and chosen style.
• We do not guarantee that the App will be uninterrupted, error-free, or available at all times.

11. Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App. Our total liability for any claim shall not exceed the amount you paid, if any, for the App or in-app purchases in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your access to the App at any time for violations of these Terms, including misuse of photos or generation of prohibited content. You may stop using the App at any time and may delete your data through the App.

13. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated through the App or its App Store listing. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law principles. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country of residence.
